1. General Provisions & Scope

These Terms of Service (General Terms & Conditions) apply to all offers, orders, purchases, and agreements made between VisniA ("we", "us", "our") and the customer ("you") through our online store at shopvisnia.com

By placing an order, you agree to be bound by these Terms of Service.

Any deviations from these terms are valid only if explicitly agreed upon in writing.

3. Products, Pricing, and Payments

·       Pricing & VAT:

All prices displayed on our website are in Euros (€) and are inclusive of statutory Dutch Value Added Tax (VAT/Btw) at 21%. Prices exclude shipping costs, which are calculated and displayed at checkout.

·       Product Descriptions:

We make every effort to display product details, specifications, and colors as accurately as possible. However, minor variations may occur depending on your screen settings.

·       Accepted Payment Methods:

Orders must be paid for in advance using our supported payment options: iDEAL, Credit Card, Bancontact, Klarna and others as displayed at checkout.

·       Order Confirmation:

Once payment is verified, you will receive an automated email confirmation summarizing your purchase.

 

4. Shipping & Delivery

Orders will be delivered to the shipping address provided during checkout.

Standard processing and shipping lead times, along with applicable delivery fees, are outlined in our Shipping Policy.

Under statutory regulations, if we cannot deliver your items within 30 days of order confirmation (unless a longer lead time was explicitly agreed upon), you have the right to cancel the order for a full, immediate refund.

 

5. Right of Withdrawal & Returns (Summary)

·       Return Window:

In accordance with EU and Dutch consumer protection laws, you have a statutory right to cancel your order within 30 days of receiving your items without providing a reason.

·       Initiating a Return:

You may initiate a return via our Contact Us page or by submitting a clear, explicit statement of withdrawal.

·       Return Costs:

o   Customer Responsibility:

If you return an item because you changed your mind, chose the wrong size, or dislike the product, you are responsible for paying the return shipping fees.

o   Company Responsibility:

If the return is due to our error (e.g., defective, damaged, or incorrect item sent), we will pay or reimburse reasonable return shipping costs.

·       Refunds:

Approved refunds will be issued back to your original payment method within 14 working days of receiving the returned goods or proof of return postage. (See our complete Return & Refund Policy for full conditions).

 

6. Exchanges

·       Direct Exchanges:

We accept direct exchanges only for a different size or color of the exact same product (or an item of equal value).

·       Switching Items:

If you wish to swap an item for a completely different product model, you must return the original item for a refund and place a new order on our website.

·       Exchange Freight:

Customers pay for return postage to send the original item back, and we will ship the replacement item to you free of charge.

 

7. Statutory Warranty (Wettelijke Garantie)

Under EU Law and the Dutch Civil Code (Artikel 7:17 Burgerlijk Wetboek), you are entitled to a statutory legal warranty on all goods purchased.

Products must conform to reasonable consumer expectations. If a product is defective or does not function as promised under normal use, you are entitled to a repair, replacement, or full/partial refund within a reasonable timeframe.

Damage resulting from normal wear and tear, improper usage, or failure to follow care instructions is excluded from warranty coverage.

 

8. Liability

Nothing in these terms limits or excludes our liability for death, personal injury, or gross negligence caused by intentional misconduct (opzet of grove schuld).

To the maximum extent permitted by applicable law, we are not liable for indirect, incidental, or consequential losses (such as loss of data or business interruption) arising from the use of our products or website.

 

9. Intellectual Property

All rights, title, and interest in the content displayed on shopvisnia.com—including but not limited to text, graphics, logos, images, software, and brand assets—are the exclusive property of VisniA and are protected by applicable trademark and copyright laws.

 

10. Applicable Law and Governing Jurisdiction

These Terms of Service and any purchase agreements between you and VisniA are governed exclusively by the laws of The Netherlands.

Any disputes arising out of or related to these terms shall be submitted to the competent district court in East Brabant, unless mandatory statutory EU consumer provisions grant you the right to bring proceedings in your home jurisdiction.
